Please read the following terms of service agreement carefully. By signing up for any Sidebar Social league and using any of our sites and services, you hereby agree to be bound by the terms and all terms incorporated herein by reference. If you do not expressly agree to all the terms and conditions, then please do not access or use our sites or our services.

ACCEPTANCE OF TERMS

The following Terms of Service (“TOS”) is a legally binding agreement that shall govern the League and its Services. The following use of “Sidebar,” “Sidebar Social,” “us,” “we,” and “our,” all relates to HJJ Enterprises. By accessing and using the Sidebar Social Services, you accept and agree to be bound by the terms and provision of the TOS.

We may amend the TOS at any time by posting a revised version on our website. The revised version will be effective at the time we post the updated Agreement.

DESCRIPTION OF SIDEBAR SOCIAL SERVICES OFFERED

HJJ Enterprises, through Sidebar Social, provides social sports leagues as well as accepts registration and payment from Participants for all league activities that Sidebar Social provides. Unless explicitly stated otherwise, any new features offered that supplements and augments this current set of services shall be subject to the TOS.

WAIVER AND RELEASE

In consideration of being allowed to participate in any way in the activities at the Sidebar outdoor deck and volleyball court, or any related events and activities on or near the Sidebar owned or leased premises, the participant acknowledges, appreciates, and agrees that:

The risk of injury from participating in these activities may be significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (as defined herein) or others, and assume full responsibility for my participation; and,
I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and immediately bring such to the attention of the nearest responsible person; and,
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Sidebar, its officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (collectively “RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent

permitted by law.

PROTECTING RIGHTS AND PRIVACY

We respect your rights and privacy and expect you to do the same. Sidebar Social reserves the right to moderate Participants’ activities and content including, but not limited to, team names and media submitted. Sidebar Social may see fit to modify, remove, or request an edited version of the content Sidebar Social finds offensive, unlawful, or that it finds malicious or disrespectful to the Sidebar Social by-laws and league rules.

We respect and are committed to protecting your privacy. We may collect personally identifiable information when you visit our site. We also automatically receive and record information on our server logs from your browser including your IP address, cookie information and the page(s) you visited. We will not sell your personally identifiable information to anyone. By agreeing to TOS you agree to have your photo used for Sidebar social media purposes or advertisement used in correlation with HJJ Enterprises.

REGISTRATION

By registering, you assure that:

You will not provide any information for anyone other than yourself without the other individual’s permission.
You will not provide ANY false personal information, whether yours or any personal information submitted for anyone other than yourself (must have their permission to submit the information) to Sidebar Social.
You will keep your contact information accurate and up-to-date.
You will not transfer your registration spot to someone else without first getting our

express and written permission.
You are/will be legal age 21 of start date of given of registered season.

TERMINATION

If you violate the letter or spirit of the TOS, or otherwise create possible legal exposure for HJJ Enterprises, we can stop providing all of Sidebar Social services to you.

PAYMENT TERMS

When making payments through the secure Sidebar Social league site, you agree to the following payment terms:

When you confirm a transaction, you agree to be bound by and pay for that transaction.
Pay attention to the details of each transaction you make, including, but not limited to,

activity, services, and specific league sport.
We provide convenient payment services so Participants can make payments using

different payment sources as well as pay for multiple team members at once.
When providing payment to Sidebar Social, you confirm that you are permitted to use that payment source. You also authorize HJJ Enterprises to collect and store it, along with

other related transaction information.
When you make a payment, you authorize HJJ Enterprises (and the payment processor used

by HJJ Enterprises) to charge the full amount to the payment source you designate for the

transaction.
If you pay by debit card and your payment results in an overdraft or other fee from your

bank, you alone are responsible for that fee.
We may cancel a payment, place a delay on a payment, or contact your payment source

issuer if we believe the transaction violates the law, Sidebar’s Terms of Service, or we believe doing so may prevent financial loss.

To the fullest extent permitted by law, you waive all claims against us related to payments unless you submit the claim to us within 30 days after the charge.
Your only remedy for a technical failure or interruption of service is to request that your transaction be completed at a later time – one that does not exceed 30 days from the failure or interruption.
WE MAKE NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO ANY GOODS OR SERVICES SOLD THROUGH HJJ Enterprises OR SIDEBAR SOCIAL.

PAYMENT SECURITY

Your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all your personal information, including credit card number, name, and address, so that it cannot be read over the internet.

OTHER

If any portion of the TOS is found to be unenforceable, the remaining portion will remain in full force and effect. Furthermore, if HJJ Enterprises fails to enforce any of the TOS, it will not be considered a waiver.
